Terms & Conditions for Ofaami - On-Demand Booking Service

These Terms & Conditions govern your use of Ofaami , an on-demand booking service website and mobile application based in Nigeria. By accessing or using the Ofaami website or mobile app (collectively referred to as "the Service"), User agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Service.

1. Acceptance of Terms

By using Ofaami, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. You acknowledge that these Terms may be updated from time to time, and it is your responsibility to review them periodically. Continued use of the Service after such updates signifies your acceptance of the revised Terms.

2. Eligibility

6. User Responsibilities

As a User, you agree to:

• Cooperate with Service Providers during your booking to ensure that services are rendered successfully.
• Respect the rights of others, including the Service Providers, and not engage in any activity that could harm the reputation or operation of Ofaami.

7. Service Provider Responsibilities

Service Providers are responsible for providing the services they advertise through Ofaami. They must:

• Comply with all applicable laws and regulations in providing services.
• Honor bookings made through Ofaami in a timely and professional manner.
• Ensure that they have the necessary skills, licenses, and insurance to perform the services they offer.

Ofaami is not responsible for the actions or omissions of Service Providers.

8. Prohibited Activities

You agree not to engage in the following prohibited activities while using Ofaami:

• Impersonating any person or entity, including Ofaami representatives.
• Engaging in illegal activities or violating local, national, or international laws.
• Collecting or harvesting personal data from other Users without their consent.
• Transmitting malware, viruses, or other harmful computer code.
• Interfering with the functioning of Ofaami’s website, mobile app, or servers.

9. Termination of Account

We reserve the right to suspend or terminate your account at any time, without notice, for violating these Terms or for any other reason deemed necessary by us. If your account is terminated, you may not access certain features of the Service, and you will forfeit any remaining balance, credits, or services.

10. Limitation of Liability

To the fullest extent permitted by law, Ofaami and its affiliates, employees, officers, and agents will not be liable for any damages, losses, or expenses arising from:

• Any interaction or dispute with Service Providers.
• Any loss of data, service interruptions, or technical errors.
• Any other indirect, incidental, or consequential damages, whether in contract, tort, or otherwise.

Our liability, if any, is limited to the amount you paid for services through Ofaami during the three months preceding the event that gave rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Ofaami, its affiliates, and its officers, employees, and agents from any claims, damages, losses, liabilities, or expenses (including legal fees) arising out of:

• Your breach of these Terms.
• Any claim brought against Ofaami or its affiliates arising from your actions, including violations of third-party rights.

All content on Ofaami, including but not limited to logos, designs, text, graphics, and software, is the property of Ofaami or its licensors and is protected by intellectual property laws. You may not use any content from the Service without express permission from Ofaami.

In the event of any dispute or claim arising from the use of Ofaami, you agree to first attempt to resolve the issue through informal means. If informal resolution fails, you agree to submit the dispute to binding arbitration in Nigeria.

Ofaami reserves the right to modify, amend, or update these Terms at any time. If we make any material changes to the Terms, we will notify you by posting the updated Terms on our website or app. The changes will take effect immediately upon posting.
